These Booking Terms and Conditions (“Terms”) govern the use of the website https://www.seasonandsensekorea.com/ (the “Website”) and the booking and participation in tours, programs and related services (collectively, the “Tours”) operated by Korea 4x5, trading as “Season & Sense Korea” (“Korea 4x5”, “we”, “us”, “our”). 

By accessing the Website, submitting a booking request, or ticking any button or box indicating that you accept these Terms, you agree to be bound by these Terms. If you do not agree, you must not use the Website or book any Tours.

These Terms do not exclude or limit any rights that you may have as a consumer under mandatory applicable law. In case of conflict between these Terms and such mandatory rights, the mandatory law will prevail.

1. About Us

1.1 The Website is operated by Korea 4x5, trading as Season & Sense Korea, which designs and operates cultural, wellness, beauty, lifestyle and food-related Tours in Korea for international visitors.

1.2 Our contact details (including email address and contact form) are set out on the “Contact” section of the Website. You should use those channels for all booking-related communications.

1.3 By using the Website or booking a Tour, you represent and warrant that:

  • (a) you are legally capable of entering into binding contracts in your country of residence;

  • (b) you are not prohibited by any applicable law from entering into these Terms or participating in Tours; and

  • (c) you are at least 19 years old, or you are a parent/legal guardian acting on behalf of a minor.

1.4 If you make a booking on behalf of other participants (including minors), you:

  • (a) confirm you have authority to act for each participant and to accept these Terms on their behalf; and

  • (b) are responsible for ensuring that all participants have read and understood these Terms and comply with them.

2. Scope of Services and Website Use

2.1 The Website is provided for the purpose of:

  • (a) presenting information about our Tours and related services; and

  • (b) enabling users to submit booking requests and complete online bookings.

2.2 Tour descriptions, photos, sample itineraries and menus on the Website are for illustrative purposes only. Actual venues, dishes, order of activities, hosts, and timings may differ due to operational, seasonal, safety, or other reasonable considerations.

 

2.3 The Website and Tours are intended for personal, non-commercial use only. You must not:

  • (a) use the Website or Tours for resale, agency, or commercial booking activity without our prior written consent;

  • (b) use automated systems or software to extract data from the Website; or

  • (c) interfere with or disrupt the proper functioning of the Website.

2.4 We may update, modify, suspend or withdraw all or any part of the Website at any time without prior

notice, for example for maintenance, security or operational reasons. We shall not be liable to you for any unavailability or interruption of the Website, save as required by applicable law.

3. Booking Process and Contract Formation

3.1 To book a Tour, you must:

  • (a) complete the booking form on the Website with accurate and complete information;

  • (b) select the desired Tour, date, time, and number of participants; and

  • (c) pay the Tour price in full using a payment method offered on the Website.

3.2 Your submission of a booking via the Website constitutes a booking request and an offer to purchase places on the selected Tour in accordance with these Terms (“Booking Request”).

3.3 A binding contract for the Tour (the “Contract”) is formed only when we send you a written booking confirmation by email (“Booking Confirmation”). Until then, we are under no obligation to accept your Booking Request.

3.4 It is your responsibility to carefully check the Booking Confirmation and ensure that all details (Tour name, date, time, number of participants, language, special requests, etc.) are correct. If you notice any errors, you must notify us without delay.

3.5 We reserve the right, acting reasonably, to decline or cancel a Booking Request at any time before the Tour takes place, including, for example, where:

  • (a) the Tour is fully booked;

  • (b) minimum participant numbers are not met;

  • (c) there has been an obvious pricing or availability error; or

  • (d) we have reasonable concerns relating to safety, legality or operational feasibility.

If we cancel before the Tour date for such reasons, you will be offered either a full refund of the Tour price paid or a suitable alternative date or Tour (if available).

4. Prices, Fees and Payment

4.1 Tour prices (the “Price”) are displayed on the Website in the currency stated. Unless specified otherwise:

  • (a) Prices include applicable local taxes; and

  • (b) Prices do not include any bank, card, foreign exchange, or other processing fees charged by your payment provider.

4.2 We may change Prices at any time. However, once a Contract is formed and you have received a Booking Confirmation, the Price for that booking will not be changed, except where an obvious and material pricing error has occurred.

4.3 Payment is due in full at the time of booking through our designated payment processor(s). By providing payment information, you:

  • (a) represent that you are authorized to use the selected payment method; and

  • (b) authorise us and/or our payment processor to charge the total Price to that method.

4.4 Where promotional or discount codes are offered, they:

  • (a) must be entered at the time of booking;

  • (b) cannot normally be applied retroactively to existing bookings; and

  • (c) unless expressly stated otherwise, do not apply to group or private bookings.

4.5 You are solely responsible for any additional charges, including foreign exchange charges, imposed by your bank or card issuer.

5. Delivery of Booking Confirmation and Tickets

5.1 Booking Confirmations and related information (meeting point, time, instructions, etc.) will be sent to the email address you provide at the time of booking.

5.2 You are responsible for:

  • (a) ensuring your email address is correct and active; and

  • (b) checking your inbox and spam/junk folders before the Tour.

5.3 You may be asked to present your Booking Confirmation (printed or on a mobile device) and, where required, proof of identity at the meeting point. Failure to do so may result in refusal of participation without refund.

5.4 We are not responsible for Booking Confirmations that are lost, deleted, filtered as spam, or sent to an incorrect email address due to information you supplied.

6. Cancellations, Changes and Refunds

6.1 Your right to cancel

6.1.1 Unless a different policy is clearly indicated on the specific Tour page or in your Booking Confirmation, our standard cancellation policy is:

  • 7 days or more before the scheduled Tour date:
    100% refund of the Tour Price.

  • 3–6 days before the scheduled Tour date:
    50% refund of the Tour Price.

  • Less than 3 days of the scheduled Tour date or in case of no-show:
    0% refund (non-refundable).

6.1.2 All cancellation requests must be made in writing using the contact details provided on the Website and must include your booking reference, name and Tour date.

6.1.3 Refunds, where applicable, will be processed using the original payment method. Processing times depend on your bank or payment provider and are outside our control.

6.1.4 If you fail to attend the Tour at the specified time and meeting point, arrive so late that you cannot reasonably join the group, or leave the Tour voluntarily, no refund will be provided.

6.1.5 Nothing in this clause affects any statutory “cooling-off” or withdrawal rights you may have under mandatory applicable consumer law. Where such rights apply, we will comply with them, and any conflicting term in this document shall be read accordingly.

6.2 Changes requested by you

6.2.1 Requests to change the date, time, or Tour type are subject to:

  • (a) availability;

  • (b) any price difference; and

  • (c) our reasonable discretion.

6.2.2 Depending on the timing and nature of your request, changing your booking may be treated as a cancellation and rebooking under the policy above.

6.3 Cancellations or changes by us

6.3.1 We may cancel or substantially modify a Tour where reasonably necessary, including due to:

  • safety concerns;

  • severe weather or public health issues;

  • guide illness or unavailability;

  • venue closure or overbooking;

  • government restrictions or events beyond our control; or

  • failure to reach the minimum number of participants.

6.3.2 Where we cancel a Tour and no suitable alternative date or Tour is available, you will be offered either:

  • (a) a full refund of the Tour Price paid; or

  • (b) a credit valid for a specified period, to be used against a future Tour.

6.3.3 If we make reasonable changes to non-essential elements of the Tour (e.g., sequence of activities, selection of restaurant/bathhouse/beauty studio, or minor timing adjustments) while maintaining the overall nature and value of the experience, such changes do not entitle you to a refund.

6.3.4 We are not liable for any indirect costs you incur (e.g. flights, accommodation, visas, other tours or transport) in connection with cancellation or changes to the Tour, except as required by mandatory law.

7. Participation Requirements, Health and Safety

7.1 You are solely responsible for determining whether you are physically and mentally able to participate in the Tour and its activities, which may include, without limitation:

  • walking, stairs, and uneven surfaces;

  • bathing and sauna (including hot and cold water);

  • exposure to humidity, heat or steam;

  • skin care and makeup sessions;

  • consumption of food and beverages (including possible allergens); and

  • sensory activities in crowded, noisy or unfamiliar environments.

7.2 You must inform us in advance (and, where relevant, inform venues directly) of:

  • (a) any allergies or dietary restrictions;

  • (b) any skin conditions, infections, or sensitivities;

  • (c) any medical conditions, pregnancy, or disabilities that may affect participation; and

  • (d) any other relevant health or mobility issues.

7.3 We and/or the venues reserve the right, in our reasonable discretion, to:

  • (a) refuse your participation in part or all of a Tour; or

  • (b) modify certain activities,
    if we consider this necessary for safety, legal, hygiene, or operational reasons. Such decisions are taken for your protection and the protection of others and do not normally give rise to refunds.

7.4 You agree to follow all:

  • instructions given by our guides and staff;

  • health and safety rules of each venue (including public baths and beauty studios);

  • dress codes, etiquette, and privacy rules (for example, in bathhouses); and

  • applicable local laws, including those regarding alcohol consumption.

7.5 We strongly recommend that you hold comprehensive travel insurance that covers medical expenses, personal accident, liability, cancellations, and loss or theft of belongings. We do not provide travel or medical insurance.

8. Behavior and Removal from Tours

8.1 We expect all participants to behave respectfully towards guides, staff, other participants, and local residents, and to respect local culture and customs.

8.2 We may, at our sole reasonable discretion, refuse participation or remove you from a Tour without refund if you:

  • arrive very late or impede the Tour schedule;

  • appear intoxicated or under the influence of drugs;

  • engage in abusive, threatening, disruptive or unsafe behavior;

  • fail to comply with safety rules, venue policies or lawful instructions; or

  • behave in a manner that we reasonably consider offensive or inappropriate (including violation of privacy or photography rules in sensitive locations).

8.3 You are responsible for your personal belongings at all times. We are not liable for loss, theft, or damage to your property, except to the extent this cannot be excluded under applicable law.

9. Third-Party Venues and Services

9.1 Our Tours frequently include services provided by independent third parties, such as:

  • public bathhouses;

  • makeup studios and beauty salons;

  • restaurants, cafés, bars and markets;

  • cultural performance venues; and

  • transportation or other local service providers.

9.2 These third-party venues and services are not owned, managed or controlled by us. Each operates under its own terms, conditions, hygiene rules and liability policies.

9.3 To the maximum extent permitted by law, we are not responsible for:

  • (a) acts or omissions of third-party venues or service providers;

  • (b) any loss, damage, injury or expense caused by a third-party venue or service provider; or

  • (c) any changes imposed by such third parties (e.g. unexpected closures, menu changes, house rules).

9.4 Any specific complaints about a venue should also be raised with that venue as soon as reasonably possible.

10. Intellectual Property and Use of Media

10.1 All intellectual property rights in the Website and its content (including text, logos, photos, design and layout) are owned by or licensed to Korea 4x5. All rights are reserved.

10.2 You may:

  • view the Website on your device; and

  • print or download extracts for your personal, non-commercial use only,
    provided that you do not remove any copyright or proprietary notices.

10.3 You must not, without our prior written consent:

  • reproduce, distribute, publicly display, or create derivative works from the Website or its content for commercial purposes;

  • use our name, logo, or brand in any manner that suggests endorsement or affiliation without permission; or

  • deep-link, scrape, or systematically extract data from the Website for commercial use.

10.4 During Tours, our guides or photographers may take group photographs or short video clips for operational records and promotional purposes. We will respect local privacy rules and cultural norms, especially in sensitive locations (e.g. bathhouses).

10.5 If you do not wish to appear in photos or videos used for promotional purposes, you must clearly inform our guide at the start of the Tour. We will make reasonable efforts to honour your request.

10.6 Unless you have objected as above, you grant us a non-exclusive, royalty-free, worldwide licence to use images and recordings in which you may appear for informational and promotional purposes (including on our Website, social media, brochures and other marketing materials), to the extent permitted by applicable law.

10.7 If you later request that we cease using a specific image or video where you are clearly identifiable,

we will use reasonable efforts to remove or stop using such media from our active channels, where technically and commercially feasible. This may not apply to materials already printed, distributed, or archived.

11. Privacy and Personal Data

11.1 We collect and process your personal data in accordance with applicable data protection laws and our Privacy Policy, which is available on the Website.

11.2 Our Privacy Policy explains, among other things:

  • what personal data we collect;

  • how and for what purposes we use it;

  • the legal bases for processing;

  • how we share data with third parties (such as payment processors and service providers); and

  • your rights in relation to your personal data.

11.3 By using the Website or making a booking, you acknowledge that you have read and understood our Privacy Policy.

12. Disclaimers and Limitation of Liability

12.1 To the maximum extent permitted by applicable law, the Website and Tours are provided on an “as is” and “as available” basis. We make reasonable efforts to keep information accurate and up to date, but we do not warrant that the Website or any content is complete, error-free, or suitable for any particular purpose.

12.2 Participation in Tours involves inherent risks associated with travel, urban environments, public spaces, food and drink consumption, wellness activities, and cultural experiences. By booking and participating, you accept these risks.

12.3 To the fullest extent permitted by law, we shall not be liable for:

  • (a) any loss or damage that is not reasonably foreseeable at the time the Contract is formed;

  • (b) any indirect, incidental, special or consequential loss (including loss of enjoyment, loss of opportunity or loss of profits);

  • (c) any loss caused by your failure to follow instructions, warnings, or venue rules;

  • (d) any loss, theft, or damage to your personal belongings; or

  • (e) any act or omission of third-party venues or service providers, except to the extent that such liability cannot be excluded under mandatory law.

12.4 To the extent we are found liable to you under these Terms or in connection with any Tour, our total aggregate liability for all claims (whether in contract, tort or otherwise) shall be limited to the total Price actually paid by you to us for the Tour that gave rise to the claim.

12.5 Nothing in these Terms excludes or limits our liability for:

  • (a) death or personal injury caused by our negligence;

  • (b) fraud or fraudulent misrepresentation; or

  • (c) any other liability that cannot be excluded or limited under applicable law.

13. Events Beyond Our Control (Force Majeure)

13.1 We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is due to events, circumstances or causes beyond our reasonable control (“Force Majeure Events”).

13.2 Force Majeure Events may include, without limitation: natural disasters, extreme weather, fire, flood, war, terrorism or threats thereof, riots, civil unrest, governmental actions, epidemics or pandemics, strikes or labour disputes, failures of transport or utilities, or unexpected venue closures.

13.3 If a Force Majeure Event affects a Tour, we will:

  • (a) use reasonable efforts to notify you as soon as practicable; and

  • (b) be entitled to cancel or modify the Tour.

13.4 In the event of cancellation due to a Force Majeure Event, we will use reasonable efforts to offer you either:

  • (a) a refund of the Tour Price, less any non-recoverable costs already incurred; or

  • (b) a credit for a future Tour, valid for a specified period.

Your specific rights in such circumstances may also be governed by mandatory consumer protection laws.

14. Changes to These Terms

14.1 We may revise these Terms from time to time. The version in force at the time you submit your Booking Request will apply to that booking, unless a change is required by law or regulatory authority.

14.2 The current version of the Terms will always be available on the Website and will indicate the date of last update.

15. Governing Law and Jurisdiction

15.1 These Terms and any disputes arising out of or in connection with them, the Website, or any Tour shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law rules.

15.2 You and we agree that the courts of Seoul, Republic of Korea shall have non-exclusive jurisdiction to settle any disputes arising from or in connection with these Terms or any Tour.

15.3 If you are a consumer and mandatory laws in your country of residence give you the right to bring claims in your local courts or under your local law, these mandatory rights remain unaffected.

16. General Provisions

16.1 Entire Agreement
These Terms, together with your Booking Confirmation and any Tour-specific conditions notified to you, constitute the entire agreement between you and us in relation to the booking and participation in the Tour and supersede any prior communications or understandings.

16.2 Severability
If any provision of these Terms is held by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary, or, if not possible, deleted. The remaining provisions shall remain in full force and effect.

16.3 Non Waiver
Any delay or failure by us to exercise any right or remedy under these Terms shall not constitute a waiver of that or any other right or remedy.

16.4 Third-Party Rights
No person other than you and us shall have any rights to enforce any of these Terms.

16.5 Language
These Terms may be translated into other languages. In the event of any inconsistency or dispute between the English version and any translation, the English version shall prevail, except where prohibited by applicable law.
